  • Reference Videos: video files you upload for motion extraction and animation reference purposes.
  • Motion Data: facial geometry, expression patterns, and movement characteristics extracted from your uploaded content for AI processing. This data is used solely to deliver the requested generation results.
  • Communications: messages, support requests, or feedback you send to us.

B. Automatically Collected Information

  • Usage Data: IP address, device type, browser, operating system, session time, and activity logs.
  • Cookies & Analytics: to analyze usage, performance, and improve the user experience.
  • Device Information: technical identifiers such as device ID or OS version for debugging and optimization.

3. How We Use Information

We process personal and technical data to:

  • Operate, maintain, and deliver the Service.
  • Manage payments, credits, and subscriptions.

4. Generated Content and User Responsibility

You own all AI-generated images you create and may use them commercially. You are solely responsible for uploaded materials and resulting outputs. You must have all necessary rights and permissions for any photo, likeness, or brand asset uploaded. Modelfy does not review, monitor, or assume responsibility for user-generated or AI-generated content. AI outputs may contain distortions, inaccuracies, or fabricated elements. Use of the Service is at your own risk.

5. Motion Control Data Processing

Modelfy's Motion Control Video feature involves the processing of sensitive data categories that may be subject to special legal protections in certain jurisdictions.

A. Types of Sensitive Data Processed

When you use Motion Control features, we may process the following categories of sensitive data:

  • Facial Geometry: measurements and structural characteristics of faces extracted from uploaded photographs
  • Expression Patterns: facial movement patterns and micro-expressions derived from reference videos
  • Motion Characteristics: body movement, gestures, and physical mannerisms extracted from video content

B. Purpose and Legal Basis

We process this sensitive data solely for the following purposes:

  • To deliver the Motion Control Video features you request
  • To generate synthetic video content based on your inputs
  • To improve the quality and accuracy of AI generation results

The legal basis for this processing is your explicit consent, which you provide by:

  • Uploading content to be processed by these features
  • Initiating generation requests that utilize these features
  • Agreeing to these Terms and the Privacy Policy

C. Data Handling and Retention

  • Motion and facial data is processed in real-time and is not retained beyond the generation session unless you save the resulting content
  • We do not create persistent biometric templates from your uploads
  • Generated content containing synthetic likenesses is retained according to our standard content retention policies

D. Third-Party Processing

To deliver these features, motion and facial data may be transmitted to our AI processing partner:

This partner processes your data solely to deliver the requested results and is contractually prohibited from using it for other purposes.

E. Your Rights and Consent Withdrawal

You have the right to:

  • Withdraw consent for motion data processing at any time
  • Request deletion of any stored content
  • Opt out of using Motion Control features entirely

To withdraw consent or exercise these rights, contact [email protected] or adjust your preferences in the app settings. Withdrawal of consent will result in the inability to use Motion Control features.

F. Jurisdictional Notices

For Illinois Residents (BIPA): Modelfy collects biometric identifiers and biometric information as defined under the Illinois Biometric Information Privacy Act. By using facial processing features, you consent to the collection, use, and storage of this data as described in this policy.

For California Residents (CCPA/CPRA): Biometric information is considered sensitive personal information under California law. You have the right to limit the use and disclosure of your sensitive personal information.

For EU/EEA Residents (GDPR): Facial geometry data may constitute special category data. Processing is based on your explicit consent under Article 9(2)(a) of the GDPR.

6. Usage Data and Analytics

We may collect anonymized or aggregated data generated through the use of Modelfy.ai (“Usage Data”). Usage Data includes technical metrics such as processing times, model usage, or feature activation rates, but never includes personally identifiable information.

Usage Data may be stored indefinitely in anonymized form.

Transactional emails and support communications may be handled by EU-based providers under equivalent privacy safeguards.

8. Data Retention

  • Uploaded and generated content is retained while you maintain an active paid subscription or unused credits.
  • If your plan expires, Modelfy retains your content for 30 days to allow renewal or reactivation.
  • After this grace period, all files are permanently deleted and cannot be restored.

9. Data Security

We implement industry-standard security practices, including:

  • AES-256 encryption in transit and at rest.
  • Role-based access control (RBAC).
  • Secure cloud infrastructure and DDoS protection.

While we take extensive precautions, no online service is completely secure. You use Modelfy.ai at your own risk.

10. Sharing and Disclosure

We share information only as necessary to operate the Service:

  • Service Providers: for hosting, payment processing, analytics, email delivery, and customer support.

10.1 AI Processing Partners

To generate the images and videos you request, Modelfy transmits your uploaded content (including photos, videos, and text prompts) to our backend and to trusted third-party AI processing partners:

  • fal - for image generation, video generation, and motion extraction
  • OpenAI - for text processing and image understanding
  • Eleven Labs - for AI voice generation using pre-licensed voice models (no user voice data is transmitted)

These partners process your content solely to deliver the AI results you request and are not permitted to use it for advertising, unrelated model training, profiling, or any secondary purposes.

These providers may rely on internal sub-processors as needed to complete the requested operations. You may withdraw your permission for this processing at any time in the app's Settings. If you withdraw consent, all AI generation features will become unavailable, as content creation requires external processing.

11. Export Control and Compliance

You agree to comply with all applicable U.S. export control and sanctions laws. You represent that you are not located in, or a resident of, any country subject to embargoes or trade restrictions, and you are not listed on any U.S. government denied-party list.

12. Your Rights

Depending on your jurisdiction (GDPR, CCPA, and similar laws), you may:

  • Access, correct, or delete your personal data.
  • Request data portability or restrict processing.
  • Withdraw consent or object to certain uses.
  • File a complaint with a data protection authority.

Users may only create or generate models that represent adults. It is strictly prohibited to upload, describe, or generate images that depict minors in any context. If we learn that information related to a minor has been submitted, we will delete it promptly and may suspend the associated account.

Motion Control Video Age Restrictions

The following additional restrictions apply specifically to Motion Control Video features:

  • No Minor Subjects: It is strictly prohibited to create Motion Control content that depicts, animates, or represents any individual under the age of 18.
  • No Minor Images: Users may not upload photographs of minors for use with Motion Control animation features.
  • No Minor Reference Videos: Reference videos containing minors may not be used for motion extraction or animation purposes.

Any attempt to use Motion Control features involving minors will result in immediate content removal, account suspension, and may be reported to appropriate authorities.

16. Updates to This Policy

We may update this Privacy Policy periodically to reflect operational or legal changes. The updated version will be posted with a new “Last Updated” date. Continued use of the Service after updates constitutes acceptance of the revised Policy.
